WKU Issues Statement In Response
To Autry Lawsuit
November 26, 2003
Bowling Green, Ky. - The University learned today that Warren Circuit Judge Tom Lewis has granted the University's Motion to Dismiss the civil suit filed against it by the Estate of Melissa Kaye Autry.
The University's Motion to Dismiss was based upon Kentucky's constitution and laws, which provide that individuals who wish to assert claims against the Commonwealth of Kentucky, including its universities, may only do so under the provisions of KRS 44 et. seq., the Board of Claims Act.
The University regrets the terrible crime that was perpetrated against Ms. Autry, and, as stated in the past, is confident that should this matter be pursued through a claim filed with the Board of Claims, the facts will show neither its staff nor its policies played a role in this tragic event.
The person or persons involved in this crime are solely responsible for Ms. Autry's death, and will be dealt with in accordance with the criminal justice system.
