November 18, 2002 WKU, Nashes Reach Lawsuit Settlement Bowling Green, Ky. - Officials at Western Kentucky University announced today that a settlement has been reached between the University, Medical Benefits Administrators Inc. and Brian "Slim" and Staci Nash.A hearing that was scheduled to take place in federal court on Tuesday on Western's motion to dismiss the suit has been cancelled based on this settlement. In the settlement, Western provided the Nashes with additional written information relating to the coverage available under Western's 2002 and 2003 health plan. No additional or special coverage provisions were provided to the Nashes under the settlement, nor is Western paying any monetary settlement to them. Medical Benefits Administrators Inc. agreed to pay a lump sum of $3,000 to the Nashes, as reimbursement for insurance consultation expenses incurred by them. No other sums of money will be paid to the Nashes. John Grise, the attorney representing Western in the litigation, indicated that the University was satisfied with the resolution, stating, "We have been working toward this outcome since the date the University announced in August that insurance coverage would be provided to cover Presley Nash's bone-marrow transplant." Western granted coverage for the procedure under its employee health plan in August of 2002. Western first became aware of Nash family's claim and Presley's condition on May 17, 2002, when their claim was denied by HCC, the University's reinsurance carrier.
